What is decennial insurance mandatory?
In France, builders’ liability insurance is subjected to public rules. Since the French Civil Code of 1804 (articles 1792 and 1792-2), the decennial liability insurance has become obligatory for all builders to protect them from any kind of disaster. Thanks to this decennial cover, builders are now physically and financially covered.
What implies a decennial liability insurance?
First, a decennial liability insurance covers you for 10 years. Actually, if you request a decennial insurance in 2014, all your constructions will be covered from 2014 to 2024. Decennial liability insurance covers constructors and building owners if major damage appears in the decade. Subscribers have to pay a premium at once or 4 times a year (every 3 months).
Who is concerned?
All construtors must have a decennial insurance. If a damage occures, they are automatically responsible for it as a damage compromises the building solvency towards the contractor.
You are considered as a builder if you are either:
- entrepreneur, technician, architect or any other person linked to the contractor
- seller once the construction that you have built or built by someone else is done
If you are not a builder, you still have to subscribe a decennial liability insurance as a planned building vendor, a property developer,a single-family house builder and a technical project manager.
